This research paper aims to collate institutes of the new Civil Procedure Code that impact and change the Brazilian Criminal Procedure, because of its subsidiary application. It starts with a brief tour of the theories of the process and the historical evolution of Criminal Procedure. Passing by the examination of the application and interpretation of the criminal procedural law, culminating in the central point of this study. Will be adopted, as a theoretical framework, the Constitutionalist process Theory, work of José Alfredo de Oliveira Baracho. As the foundation, and success of this study we have the literature and deductive method.
