WPŁYW OGŁOSZENIA UPADŁOŚCI KONSUMENCKIEJ NA WYKONYWANIE UMÓW, KTÓRYCH STRONĄ JEST UPADŁY – ZAGADNIENIA WYBRANE

Abstract

The article concerns the question of execution of contracts of which consumer bankrupt is a party. Of particular interest is that general bankruptcy laws concerning the above issue (i.e.execution of contracts of which a bankrupt is a party) are only mutatis mutandis (and not directly) applicable to consumer bankruptcy situations. This mode of regulation may evoke doubts as to how far general bankruptcy laws can be modified as far as consumer bankruptcy is concerned so that ratio legis of this latter institution is fulfilled, that is, a bankrupt debtor was fully liberated from his obligations.
