La dogmatique du genre dans la matrice doctrinale du « droit français » (second xvie siècle)

Abstract

The first architects of French law could only use the notion of gender in its original logical meaning. However, to the extent that they envisaged the human race as the universality of individuals of the female and male sexes, their stories are also steeped in gendered representations. On the borders of logic and social imaginary, this analysis demonstrates the sociological intelligence of this generation of jurists prey to the decay of the body politic in the last third of the 16th century.
