IMPLEMENTASI UNDANG-UNDANG NOMOR 41 TAHUN 2009 TENTANG PERLINDUNGAN LAHAN PERTANIAN PANGAN BERKELANJUTAN YANG MASIH PRODUKTIF ( Studi kasus di BPN Kota Kediri )

Abstract

Referring to laws and regulations, the government's goal is to make regulations so that agricultural land is no longer suspended as non-agricultural land, as stated in the Sustainable Food Agriculture Protection Act No. 41 of 2009, paragraph 15, reads Maatalousmaa sustainable food transition operations changing land functions sustainable food cropping into unsustainable food cropping land either permanently or temporarily. In addition, Article 144 of the Law on Housing and Residential Areas No. 1 of 2011 states that "Legal entities that build and residential areas cannot move infrastructure and utility facilities outside of their business activities." . In the framework of implementing Law Number 41 of 2009 concerning the Protection of Sustainable Agricultural Land in the City of Kediri, arrangements will be made taking into account hierarchy of functions related to development allotment and land allotment. In line with this, the City of Kediri has also issued Regional Regulation Number 8 of 2019 concerning Conservation of Sustainable Agricultural Land (LP2B) and Monitoring and Evaluation of the Conversion of Paddy Fields into Settlements. To support the success of the intended program, we need to ensure that rice fields are designated as sustainable food farming land. This research is an empirical or socio-legal research that examines legal provisions that live in society by using a legal sociological approach. means not fulfilling the provisions and regulations regarding the conversion of agricultural land from agricultural land to non-agricultural land, especially near the Kediri City Land Agency/ BPN hectares consisting of paddy fields and dry land spread. or more districts.
