THE ROLL PLAYED BY INSS AS A REPEAT PLAYER – AN ANALYSIS IN LIGHT OF THE EXTRAORDINARY APPEAL Nº 631.240
Abstract
This study sought to identify if the INSS, as a repeat player, obtained advantages in the judgment of Extraordinary Appeal No. 631,240, according to Marc’s Galanter tipology of parties to the judicial system. The discussion holds relevance to the phenomenon of mass litigation, to the way repeat players engage in conflicts, as well as highlights the means by which the relationship between the principles of efficiency and access to justice is being debated. The examination was conducted using qualitative empiric analysis (case study, interview and documental analysis) and a theoretical mark (Marc Galanter). At the end, the research hypothesis was confirmed.
