The main point of this investigation refers to the Spanish Constitution of 1812, especially the debates developed in the Constitutional Courts according to the colonial problem. Firstly, the situation of the cuban society is characterized from the political, economic and cultural points of view. Secondly, an evaluation of the implications of the constitution in Cuba taking into account the proposals made by the members of parliament that were written into articles. The analysis is made to its first period of applications. The implications are emphasized in reference to the problem of slavery and its possible changes in the colonial administration, nevertheless, it did not make any significant change in this aspect.
