O PERFIL DO ESTADO-JUIZ E A SUBSUNÇÃO

Abstract

The State exercises judicial functions through magistrates, to whom the Constitution of the Republic recognizes particular guarantees to ensure independence and impartiality. The jurisdictional function is the formal object of the study of a branch of law called the General Theory of the Process. The article deals with the Judicial function and the technique of the subsumption of judgments in the Brazilian Judiciary.
