The New European Commission Decision on Standard Contractual Clauses: A System Reform?

Abstract

(Series Information) European Papers - A Journal on Law and Integration, 2021 6(3), 1363-1365 | European Forum Highlight of 24 February 2022 | (Abstract) The evolution of an increasingly globalized market has resulted in the expansion of international trade through transnational data flows. Standard contractual clauses (SCC) are one of the most commonly used legal bases for transferring personal data beyond EU borders. The new Decision of the Commission on SCC represents a major innovation for the transfers of data. This Highlight offers an overview of the model clauses and addresses some of its new features, especially as to the relationship with art. 3(2) of Regulation (EU) 679/2016.
