SPECIALIST PROFESIONAL FOSTER FAMILY AS AN EDUCATIONAL MEASURE USED TOWARDS MINORS
Abstract
A specialist professional foster family is an educational measure that the court may apply to a minor showing signs of demoralization or committing criminal acts. Although its ruling results in the separation of the minor from the natural family, it has a different specificity than strictly isolating educational measures. A juvenile is provided with conditions for upbringing and development in a foster family environment. The foster family is a form of helping the natural family to reintegrate. In this way, implementing one of the basic rights of the child, which is the right to be brought up in a family. In practice, however, the courts rarely adjudicate it. The reasons for this state of affairs should be sought, on the one hand, in the fact that the possibility of using this educational measure depends on demonstrating the impact of improper performance of the educational and socialization function by the juvenile's family on his demoralization or committing a punishable act. On the other hand, there is an insufficient number of foster families prepared to care for a minor who has come into conflict with the law or violated the rules of social coexistence.This article is devoted to the analysis of one of the educational measures that the court may apply to a juvenile showing signs of demoralization or committing a punishable act, which is placing in a professional foster family. In existing studies in the field of proceedings in juvenile cases, even those focusing on educational measures, the authors devoted little space to this particular measure. This article has attempted to fill this gap.
