Abstract

This article deals on the institute ofthe diplomatic protection in a historical perspective,stressing mainly the ruptures and continuitiesamong the notions elaborated in theworks done in the sphere of the InternationalLaw Committee of the United Nations (UN)and the interpretations of the InternationalCourt of Justice.O presente artigo trata do instituto da proteção diplomática em uma perspectiva histórica, salientando principalmente as rupturas e continuidades presentes entre as noções elaboradas nos trabalhos realizados no âmbito da Comissão de Direito Internacional da Organização das Nações Unidas (ONU) e as interpretações da Corte Internacional de Justiça.
