SUBJECT COMPOSITION OF PARTICIPANTS IN LEGAL RELATIONS RELATED TO THE PROTECTION OF INTELLECTUAL PROPERTY IN EDUCATIONAL INSTITUTIONS
Abstract
Purpose. The purpose of the presented work is the study and analysis of the subject composition of participants in legal relations related to the protection of intellectual property in educational institutions, the identification of their rights and obligations, as well as the definition of mechanisms for the protection of intellectual rights in the educational environment. At the same time, it is taken into account that trends in the commercialization of educational materials and to increase their marketability in the market cause a significant expansion of the subject composition, in particular, educational platforms are expanding, specialized organizations engaged in relevant activities appear, as well as specialists engaged in the preparation of educational and educational material. Methodology. The methodology of the scientific article consisted of theoretical analysis (study and analysis of legislation regulating intellectual property, review of scientific publications and research on intellectual property in educational institutions), and empirical generalization (collection and analysis of data on subjects of legal relations in educational institutions, materials of law enforcement practice). Results. The conclusion was that the emergence of new participants is due not only to the labor principles of the legal relationship, in which the employee and the employer act as subjects, but also to civil law, which indicates the dynamics of intersectoral regulation of legal relations aimed at creating intellectual property objects in the field of education. Practical implications. The results of the study can be used for the development and implementation of internal regulations in educational institutions regulating the protection of intellectual property, as well as for the generalization and analysis of materials of law enforcement practice.
