CONSTITUTIONAL ANALYSIS ON AMENDMENTS TO LAW No.317/2004

Abstract

This study seeks to analyze the amendments made to Law no.317/2004 on the Superior Council of Magistracy, which has let to extensive debates in the Romanian public and legal space. The analysis is based on the jurisprudence of the Constitutional Court of Romania, which claims several important constitutional principles for the organization and functioning of the Superior Council of Magistracy, the independence of the justice being the focus of the Constitutional Court.
