Abstract Divorce between law. Islamic law and social reality in society in Hilla courts. The aim of research try to study the subject from three faces. Legal law and social. The first explained arbitrary divorce. The second clarified the totality in the cases of judicial differentiation. The third discuss residence of divorce in the house of husband.it appear from research the number of divorces in Hilla city in 2014 about half of Marriages 3686 status and the divorce status1642. The causes of these cases are economic causes about 70% social causes20% .family dispute and family intervention 10%
