Panorama actual de la evaluación ex post: ¿ornamento o aspiración democrática para las administraciones públicas?

Abstract

The field of evaluation of legal norms and public policies of public administrations is gradually making its way into our legal system. In recent years there have been a number of regulatory developments that have boosted the evaluation activity in our legal environment. Ex post evaluation is a tool that was incorporated into our law almost a decade ago by means of Act 39/2015. That incorporation, however, has not had a subsequent development or momentum. Development and momentum that the ex ante evaluation has had by contrast. The purpose of this article is to describe the current state of ex post evaluation in our legal system, detecting its strengths and weaknesses in order to provide discernment that may help its desirable evolution in the not too distant future.
