VIEWS OF PROFESSOR VLADIMIR SERGEYEVICH COMMISSAROV ON THE INSTITUTE OF COMPLICITY IN CRIME IN THE CONTEXT OF MODERN RUSSIAN, INTERNATIONAL AND FOREIGN CRIMINAL LEGISLATION

Abstract

The article presents some key (conceptual) ideas of professor V.S. Commissarov on complicity in crime through their extrapolation into modern Russian, international (UN, SCO, CIS) and foreign legislation (on the example of the People’s Republic of China, the Kyrgyz Republic, the Republic of Belarus, the Republic of Tajikistan). Purpose: to show the importance of the creative heritage of Professor V.S. Komissarov for understanding the legislative approaches to the design of the institution of complicity in crime at the Russian, international and foreign levels. Methods: dialectical, analysis, synthesis, induction, deduction, as well as specific scientific (historical-legal, comparative-legal and formal-legal). Results: the article establishes the relationship and consonance of doctrinal ideas of Professor V.S. Komissarov with the resolution at the legal (legislative) level of such issues as the object of banditry and creation of a criminal community, content of the constitutive feature of gang stability, diversification of organized crime in the context of its manifestation in the form of an extremist organization and a subversive community, changes in the interpretation of the institute of complicity in crime in international criminal law from the point of view of the processes of deglobalization and regionalization taking place in it.
