La insoportable levedad del ser “pacto sucesorio europeo”

Abstract

The main aim of this article is to address the issue of agreements as to succession in the light of the Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession. Article 25 of the provision links the agreement as to succession to the socalled hypothetical succession law as to its admissibility, substantial validity and effects between the parties with results far from satisfactory.
