Moral Hazard on the contract relation between cooperative and its members Moral Hazard na relação contratual entre cooperativa e cooperado

Abstract

This paper presents the theoretic and doctrinal concepts that rule agriculture and farming, the definitions of Moral Hazard and describes how the moral risk empirically happens in agricultural cooperatives and verifies whether there are mechanisms in Brazilian institutions to reduce the presence of these organizations. The law, the statutes, the principles and the cooperatives values establish that it is possible to adopt monitoring, incentives and punishment. However, the studied cooperative managers have been using some of the monitoring and incentives and have not been using the punishment ones, claiming that the principles and values that rule the cooperatives do not permit some of these actions.O presente trabalho apresenta os conceitos teóricos e doutrinários que regem uma cooperativa agropecuária, as definições de Moral Hazard e faz ainda uma descrição de como o risco moral ocorre empiricamente numa cooperativa agropecuária. A partir daí é averiguado se existem mecanismos previstos nas instituições formais que regem as cooperativas brasileiras para reduzir sua presença. A lei, os estatutos, os princípios e os valores do cooperativismo estabelecem que é possível adotar mecanismos de monitoramento, incentivo e punição. Entretanto, os gestores da cooperativa estudada têm utilizado somente parte dos mecanismos de monitoramento e incentivo e não têm usado os de punição, com a justificativa de que os princípios e valores que regem o cooperativismo não permitem algumas dessas ações
