IMPLIKASI YURIDIS KEKABURAN NORMA TINDAK PIDANA PENGHINAAN PRESIDEN DAN/ATAU WAKIL PRESIDEN

Abstract

Insulting the President and/or Vice President has recently been reappeared in Law Number 1 of 2023 concerning the Criminal Code (KUHP) precisely in article 218, the issue of vagueness arises because the explanation of article 218 paragraph (1) does not provide clear limits on what actions can make the President and/or Vice President feel his dignity is humiliated. The research method used is normative juridical, using a statutory approach and conceptual approach, and the analysis of legal materials in this research is grаmаticаl interpretation. The results obtained from this research are that the existence of normative vagueness of the criminal offence of insulting the President and/or Vice President is the first to cause multiple interpretations, theemergence of arbitrariness, and does not reflect the principle of clarity of formulation
