Cómo identificar un “matrimonio de conveniencia” en España / How to identify a “marriage of convenience” in Spain

Abstract

A very common phenomenon in countries under strong immigration and that is beginning to be quite important in Spain, which has gone from being a country of emigration abroad, to being a country that receives citizens who come from other countries to live here, is the problem of the so-called "marriages of convenience". The true objective of these "marriages" is to obtain certain "benefits" in terms of nationality and immigration (fast and privileged acquisition of Spanish nationality, obtaining a residence permit in Spain, family reunification, etc.). Therefore, they are a form of fraud against the Immigration and Nationality norms. This paper seeks to highlight some relevant indications that allow us to identify a possible marriage of convenience based on the registration doctrine and the guidelines of the European Union.
