PREPARATION FOR RELEASE FROM PRISON ON THE BASIS OF ART. 164 OF PENAL ENFORCEMENT CODE. IMPLEMENTATION STATUS AND NEEDS OF SYSTEM SOLUTIONS

Abstract

The presented article addresses the issue of readaptation of convicts, as part of a program of preparation for release from prison on the basis of art. 164 of the Executive Penal Code. The article outlines the institution of executive penal law. Following this, it defi nes the areas of activity and specifi c tasks of probation offi cers for adults, who are in charge of preparing convicts to leave the prison, whereby analyzing them in the light of the applicable regulations and the author’s own practice. The author describes the defi ciencies in the applicable provisions regarding the detailed specifi cation of tasks and procedures of the body preparing the “release program”. The paper also indicates individual examples, highlighting the need to develop specifi c legal regulations. The author postulates the development of a coherent and complementary system of social readaptation of convicts, clearly defi ning the roles and responsibilities of each institution obliged to implement the fore-mentioned objective.
