Historically, Japanese tribunals and courts have played a significant role in protecting the victims of pollution. However, the fact that Japan, contrary to international trends, recognizes neither environmental rights nor public interest litigation in the environmental field, raises several difficulties. Taking a critical look at the development of personality rights through civil and administrative case litigation, this article explores the potential benefits and limitations of court rulings within the field of environmental protection and climate change.
