Art. 6 of the European Convention of Human Rights guarantees the right at the equitable and public process of the civil rights and obligations of a person or of any criminal charge or accusation against him. Notwithstanding the fact that the European Convention does not expressly refer to the notion of a „equitable process”, the European Court of Human Rights try to designate all the rights granted to the litigants, so that each State party to the Convention has the duty to ensure every citizen the enjoyment of an adequate environment for the protection of the rights and freedoms guaranteed.
