The Constitutional Court in light of the Algerian Constitutional Amendment of 2020
Abstract
The Algerian constitutional founder created the Constitutional Court following the constitutional amendment of the year 2020, which was a quantum leap in ascending from the Constitutional Council to a constitutional court, with the aim of strengthening the building of the state of law and institutions. The announcement of the birth of the Constitutional Court enabled the transition from the method of political control over the constitutionality of laws that were practiced By the Constitutional Council, to the method of judicial oversight of the constitutionality of laws in force in many comparative constitutional systems, which are undertaken by the constitutional courts. The Constitutional Court in Algeria records many amendments, both in terms of the framework that regulates them in the organic aspect compared to what was the case in the past under the control of the Constitutional Council, through the representation of professors of constitutional law, and in the functional aspect, through the expansion of its competencies and tasks according to what Determined by the new constitutional amendment.
