International Jurisdiction on Disputes of Damage Resulting from Transboundary Environmental Pollution

The question of environmental pollution raises many legal problems when its effects extend beyond the one state’s borders. The most apparent problem made by this issue is the International jurisdictional competence associated with the dispute of compensation claim for the damage coming out from transboundary environmental pollution. In this case, the competent courts in such type of conflicts will play an important role offering or granting fair compensations to victims. Therefore, these conflicts cannot be settled only with the Public International Law rules, but it has to make use of the Private International Law rules, as well, for what they provide effectiveness of compensations for environment pollution’s damage.
