The Pejotização the Provision of Services Public Health Public Administration Brasileira

Abstract

This article aims to promote a critical and analytical study on the phenomenon called "pejotização" (the recruitment of workers through the establishment of a legal entity) within the public administration, notably in the public health sector. At first, will be approached the historical and social events and their legal implications for understanding the flexibility and precarious employment relationships. Then, will be discussed all social, legal and principled issues that permeate this fraudulent phenomenon, exposing some jurisprudential positions on the subject. Also, will be discussed the role of the MPT and its Coordenadoria de Combate às Fraudes na Administração Pública.
