“Esperteza” e “bom comportamento” na execução penal

Abstract

This article analyses arbitrary criteria that affect the rights of the person deprived of liberty in the course of the criminal enforcement process. Based on socio-juridical research, interdisciplinary theoretical reference and institutes as the progression of regime and conditional release, it is approached that the criminal execution is based on arbitrary criteria and results in a social insecurity related to the expectation, concession and access to the rights of the person deprived of liberty.
