The default has been regulated from a perspective focused on protecting the debtor. Nowadays, this view has become outdated and it is necessary to redesign it. In this article, the author studies the default with the support of the Italian doctrine. In this order, he addresses issues such as the assignation of the amounts to be payed and the onus of cooperation that falls on the creditor.
