Work at Conditions Similar to Slave: Divergences in the Jurisprudence and the STF'S Omission in Recognize the General Repercussion About This Subject
Abstract
This study aims to examine how the non-recognition of general repercussion by the Supreme Court in cases involving the contemporary slave labor contributes to the maintenance of existing jurisprudential disagreements within the TRF's. Begins with a brief discussion about the characterization of this criminal act, highlighting the controversies regarding the protected legal interest by art. 149, CPB. Follows analyzing the interpretation given by the Supreme Court on the subject. Terminates demonstrating existing interpretive differences within the TRF's, and the need for recognition of general repercussion for the guarantee of fundamental rights and guarantees.
