Conflictos competenciales sobre la seguridad pública en materia de Administración Digital y Telecomunicaciones. Comentario a las SSTC 10/2023, 20/2023, 36/2023 y 60/2023 sobre el Real Decreto-Ley 14/2019, de 31 de octubre

Abstract

It is here reported the four rulings of the Constitutional Court ¿Constitutional Court Judgment (CCJ) 10/2023, 20/2023, 36/2023 and 60/2023¿,rendered on the Royal Decree Law 14/2019, known as ¿digital 155¿, in which,as a matter of extraordinary and urgent necessity, the Government regulatedaspects regarding the guarantee of citizens¿ rights and public security in adigital environment. Among them, the recognition of the State¿s competenceto regulate basic aspects of electronic administration associated with the selforganizationof public administrations stands out, such as the prohibition ofemerging technologies when it deems it necessary for reasons of legal certaintyof the electronic relations between administration and citizens.
