THE VALUTION OF INVESTIGATIVE FINDINGS AS PROOF UNDER RULE 13.964/19

Abstract

This paper aims to examine how investigative findings obtained in the early stages of criminal prosecution resonates on the final ruling, as well as the repercutions of the modifications introduced by “Lei nº 13.964/19” in this matter, particularly in what concerns the creation of the “judge of guarantees” and the exclusion of preliminary pieces of evidence from the records that will be subjected to analysis by the judge of the case.
