Los residuos generados por la industria extractiva: virtudes y deficiencias del marco regulador

Abstract

The recent reform of the Royal Decree on waste management and rehabilitation of areas affected by mining has highlighted the importance of the environmental perspective in extractive activities. From the Community provisions on this subject, this study analyzes the strengths and weaknesses of a regulation that tries to balance the demands of the industry and the efforts to protect the areas affected by these activities. The controversy generated by mining activities, the environmental consequences, the risk of serious accidents and the difficulties in the management of waste are a challenge to a regulation that attempts to offer a solution to the demand of mineral resources and environmental protection.
