This paper aims to present the current legal regulation of copyright as a form of an intellectual property. What are the obstacles and challenges for the materialization of constitutional copyrights but also what represents limitation of free flow of information and knowledge access? The paper includes examples of a copyright infringement. Methods which we used are: Analysis of newspaper articles, various portals, current legislative, conventions, reports and documents of governmental and non-governmental organizations. The current legal framework for copyright protection is not fully in line with the technological development. This results in a lack of adequate protection of some copyrights and contributes to their easier violation. On the other hand, too strict and inflexible rules lead to difficulties in the flow of information and knowledge which obstructs development, creativity, inventiveness and innovation. Society is faced with this challenge and it requires an appropriate solution to reconcile and harmonize these two clashing requirements.
