Las cláusulas sociales en los contratos públicos: ¿Son contrarias al Derecho comunitario?

Abstract

The present study analyzes if a contracting authority of a Member State have the power to require tenderers and their subcontractors to undertake to pay the statutory minimum hourly wage to the personnel who will be responsible for performing the work forming the subject-matter of that contract. El presente estudio analiza si la autoridad de un Estado miembro está facultada para exigir a licitadores y subcontratistas que se comprometan a pagar el salario por hora mínimo legal establecido a los trabajadores encargados de ejecutar las prestaciones objeto de dicho contrato
