La justicia transicional y el caso colombiano: el derecho a la verdad como pilar fundamental para lograr la justicia y la reparación

Abstract

This paper studies the importance of the right to truth for victims and society in processes of tran­sition out of the armed conflict in Colombia. The hypothesis is that in the processes of transitional justice judicial truth favors offenders, while social or extrajudicial truth privilege victims. A guarantee of judicial truth from legal proceedings or extrajudicial truth (memory commissions) will help victims feel included in the processes of transition out of the war. / The reflections developed herein are drawn from content analysis of scientific documents by recog­nized experts on the subject, as well as the review of legal and regulatory frameworks that have addressed transitional justice in Colombia.
