La justicia transicional y el caso colombiano: el derecho a la verdad como pilar fundamental para lograr la justicia y la reparación
Abstract
This paper studies the importance of the right to truth for victims and society in processes of transition out of the armed conflict in Colombia. The hypothesis is that in the processes of transitional justice judicial truth favors offenders, while social or extrajudicial truth privilege victims. A guarantee of judicial truth from legal proceedings or extrajudicial truth (memory commissions) will help victims feel included in the processes of transition out of the war. / The reflections developed herein are drawn from content analysis of scientific documents by recognized experts on the subject, as well as the review of legal and regulatory frameworks that have addressed transitional justice in Colombia.
