Abstract

Artigo referente à judicialização do Benefício de Prestação Continuada (BPC), desenvolvido através de análise empírica em banco de dados sobre o benefício. O estudo analisou a relevância do Judiciário na garantia dos direitos constitucionais e o importante papel exercido no decurso do BPC. No entanto, identificou o reforço da desigualdade por parte do Judiciário, por meio do acesso desigual as suas instâncias nas grandes regiões brasileiras e pontuou a necessidade de aprimoramento das funções do Judiciário em prol de ações voltadas para o aprofundamento da cidadania e da concretização dos direitos sociais.This article is based on the legalization of the Continued Benefit Payments (BPC), developed through an empirical analysis in a database about the benefit. The study examined the relevance of the judiciary in ensuring the constitutional rights, and the important role played during the BPC, however, it identified the strengthening of inequality by judiciary, unequal access through to their bodies in large Brazilian regions and pointed out the need for enhancement of the judiciary functions in favor of actions for the strengthening of citizenship and the realization of social rights.
