The French example of planned contracts between the State and the region: development and practical significance
Abstract
Professor Gidara dealt in general with the legal aspects of contractual procedures among public communities, in particular with those between the State and local communities. However, I propose to refer to administrative procedure and the achievements of planned contracts between the State and the regions in France. I believe that the method of harmonised, fixed contractual activity between the State and public communities is in general one of the ways and means of good administration – bonne gouvernance/good governance. Given that I have participated in thet inception and implementation of such contracts between the State and the French regions. In this paper I present a brief analysis of the inception and development of these contractual relations and their effects and significance. I therefore leave aside another also interesting form of public contract which is very developed and diverse and that is contractual cooperation which in France only exists among the local communities themselves.
