Notary in company law of Bosnia and Herzegovina and its comparison with notary of Germanic area countries

Abstract

The purpose of this paper is to present legislative solutions and practical achievements in the ten-year practice, and application of notaries in the Company Law of Bosnia and Herzegovina (BiH), as well as their solutions comparing with countries of the Germanic areas (Germany and Austria). The paper sets out regulations governing the status of the economic society in BiH, showing the role of notaries in the Company Law of BiH and gives suggestions de lege ferenda to the institute notaries in BiH, which could be at least close to the German and Austrian practices of notaries right of companies. This is especially the face of this, that the Law on Notaries in BiH is adopted under the special influence of German law, but in practice however revealed certain deficiencies which reflect on a general level - the level of BiH.
