Abstract

Provided by the Romanian Criminal Code which entered into force in 2024, trespassing in professional offices is regulated as criminal offence within the chapter against home and private life, together with trespassing, violation of privacy and disclosure of professional secrecy. As the Romanian case law started to be solid in this field, a series of aspects requiring clarification still remain, such as the proper determination of the object of protection and – closely related to this matter – of the victim of this criminal offence, as well as the meaning of „professional office”. The comparison with trespassing is of a real help in solving such issues.
