Tasks of local government in states of emergency in the perspective of human rights protection

Objectives The main purpose of this article is to discuss the constitutional aspects of the tasks of local government in the protection of human rights in states of emergency. The author in particular takes into account the practical aspects of the aforementioned matter and its importance in the national legal system. A special subject of research and analysis is Chapter XI of the Constitution of the Republic of Poland, while the subject matter taken up by the author is particularly important in view of the current Euroregional situation, as well as the armed conflict in Ukraine. Material and methods In order to conduct the research, both Polish and foreign literature on the subject was used. The author used primarily the dogmatic and legal method and, in addition, the historical and legal and comparative methods. Results As a result of the research it was found that, Regulations of constitutional and statutory rank concerning the state of emergency are aimed at ensuring the effective functioning of the state in crisis conditions in the internal sphere and leading to the restoration of the normal state as soon as possible. In the event of threats, the key role is played by local governments as the basic units of local government. Local authorities are tasked with preventing security risks and, should they occur, minimizing the negative impact. Conclusions The author came to conclusion that, a sense of security is an important element of everyone's life. An expression of protecting this sense is the development and adoption of appropriate acts. In the event of threats, local governments play a key role as the basic units of local government.
