Sistemas de supervisão regulatória: análise comparativa e possíveis contribuições para a regulação no Brasil
Abstract
[Purpose] This article analyzes recent reforms to improve regulatory policies in Brazil and in foreign jurisdictions, as well as contributions of oversight systems, which include creating regulatory oversight bodies (ROBs) to increase efficiency and technical quality of normative acts. [Methodology/approach/design] In this sense, the article uses the methodology of comparative law to analyze ROBs in the United States, Mexico and Australia, in order to identify similarities, differences and best practices that could contribute to regulation in Brazil. [Findings] The conclusion is that common aspects of foreign countries’ experience can be used as a starting point, but must be combined with the definition of political priorities for the design of an effective regulatory supervision system.
