PROBLEMS OF QUALIFICATION OF CRIMINAL OFFENCES CONNECTED WITH ABUSE OF OFFICE AND EXCEEDING OFFICIAL POWER
Abstract
The paper considers some issues of qualification of crimes under articles 285 and 286 of the criminal code, differentiates the offences between the two articles and distinguishes them from related crimes subject to the rules of qualification within criminal legal norms competition. The study was conducted on the basis of the results of criminal cases investigation by the Investigation Department of Kemerovo Region Division of the Investigative Committee of the Russian Federation in 2007 – 2012.
