Constitutional initiatives for free enterprise and microentrepreneures: analysis of insufficient stimulus of Brazilian entrepreneurship
Abstract
This paper studies the constitutional institute of free initiative, as guaranteed by Article 1, IV, of the Brazilian Federal Constitution – as one of the many foundations of the Democratic State of Law. Moreover, this research is fundamentally constructed on philosophical, judicial and sociological premises of entrepreneurship; thus, this paper analyzes the many difficulties faced by microentrepreneurs in Brazil in a critical way, with a legal and doctrinal approach. Furthermore, this research explores failures of the microenterprise stimulus system and the various difficulties that small Brazilian entrepreneurs are currently experiencing in order to keep their businesses running. Therefore, in this context, one of the main objectives of this scientific article is to find solutions that stimulates economic activity of small Brazilian entrepreneurs and, consequently, fosters employment and income growth.
