Medical law litigation

Abstract

Medical law, which has been developed and fully recognized in Western European countries, is still in its infancy in our country. As the development of medicine and the increased use of different methods of treatment has occurred in our society, the number of litigations in this field has also increased. The subject of the proceedings is compensation for damages due to medical malpractice. In this regard, domestic case law has produced certain solutions which are somewhat different from the general postulates of the Law of Contract and Torts. Along with this practice, it is necessary to point out the case law of the European Court of Human Rights in this area.
