Abstract

Ownership of archive materials. Several comments about the need to amend legislation The article presents the problem of ownership relations in the area of archival materials. This issue is not easy, also due to the political transformations that took place in Poland. The author does not believe that a new law on archives should be enacted. Nevertheless, the current law (Law on National Archival Fonds and Archives) requires thorough amendment. In the article, the author tries to indicate which provisions should be changed. These provisions concern various legal issues, not just the fundamental structure of the national archival fonds. The legal regulations related to what happens to archive materials following bankruptcy and liquidation are not less important.
