Social rights as part of sustainability and justification of the democratic rule of law
Abstract
Social rights express a desire to carry out an equality that is substantial. However, there is still strong resistance not only to the recognition of fundamental rights status of those rights as well as the immediate and direct linking of the state in its provision. From this, the present work aims to deconstruct some of these criticisms to demonstrate the fundamentality of social rights and its undeniable ethical and legal importance in the structuring and support of their own democratic state.
