The paper is divided into four sections: 1) First, in an international context ofjust war tradition, I examine Kelsen’s ideas of the demise of the concept of sovranity, as well the Hart’s question “Is international law really law?”. Finally, is global terrorism supreme emergency or distributive justice? 2) I deal with power-sharing democracy in post-conflict societies, under the auspices of liberal peacebuilding. 3) After analysing the concept of refugee in the Refugee Convention, and how is hard for poverty migrant be awarded Asylum, I describe theSally Haslanger’s conception of race, and the Critical Race Theory. 4) Building on Carens’s distinction between realistic and idealistic approaches to the issue of populist anti-immigrant sentiments, I offer some guidances to policymakers.
