Abstract

The following article is devoted to the issue of “lending resources” of third parties to ensure compliance with the tender (procedure) participation requirements. The practice that has developed over several years provisions allowing such actions have been in effect does not inspire confidence of the holders of public funds and does not guarantee the realization of orders by parties in possession of qualifications and skills (knowledge and experience) required as an example at the tender stage. Irregularities in this area and inconsistent case law forced introduction of new legal regulations, which are generally needed, however, in such form may be difficult to apply.
