Analysis of Legal Actions on the Fundamental Principles of the Turkish National Education

Today’s Fundamental Principles of Turkish National Education are based on fourteen tenets that were designed and legislated in 1973 numbered 1739 of 4th and 17th clauses of the Basic Law of National Education. This study aims to examine the subject matters and realms of lawsuits brought against adducing these fourteen educational principles. Twenty-four cases opened between 1982 and 2013 were reached by the records of The State Council. The research figures out that all were brought before the court referring 27 times to ten fundamental educational principles and it is observed that there was no any legal action taken on the grounds of the remaining four principles. This research unveils different views between rulings of administrative court and the verdicts of the State Council. It also aims to shed light on future studies on the point of outcomes it has produced.
