INFORMED CONSENT AS A LEGAL MEANS OF REGULATING MEDICAL RELATIONS
Abstract
The concept of informed consent seems to be important in scientific research involving medical interventions and in clinical practice. This makes the study of this legal institution timely and relevant. Purpose: based on the results of the analysis of the formation and development of the institution of informed consent, to identify trends in its further development. Methods: systemic and structural-functional analysis, as well as special legal methods: comparative legal, formal legal, legal modeling, interpretation. Results: the article gives scientifically based proposals for improving the legal institution of informed consent. The article substantiates the conclusion that the content of consent should be absolutely transparent and understandable to all subjects involved, so that it really acts as an effective means of legal regulation of social relations related to medical intervention or research.
