Political and legal aspects of overcoming bureaucracy in the civil service of Ukraine
Abstract
The article revealed signs of bureaucracy in the civil service of Ukraine and describe the main political and legal mechanisms to its overcome. It is shown that its negative consequences in Modern Ukraine bureaucracy becomes different manifestations, chief of which is the formalization of relations between people when to resolve any issues requiring official a plurality of reference, introduced unfounded restrictions numerous approvals at solving a simple question, and the excess of centralization others; a plurality of bosses, that bloated and confused by their functional responsibilities device management, which includes a large numbr unnecessary links; «Bureaucratic loop» when the complaint to a higher authority sent him to the body, which challenged action; Paper work style, the excess role exaggeration documentary side of things; substitution of statutory regulations or other subordinate legislation under the guise concrete definition of law; «Omnipotence» of bureaucrats, the actual prevalence of the administrative apparatus of the bodies formed in order of election; the excess, petty regulation of actions and whereas when implemented properly secured usual common sense; localism as the order of classes according to the positions of social status of the applicant or his relatives or compliance narrow local interests at the expense of General case, the case of the State; absence or ignoring clearly established time frames consideration of citizens and legal entities, leading to delays in decision cases of infinite necessary and unnecessary coordination with other units apparatus; conservatism, which quite often takes the form of unwavering backwardness and aggressive anti-innovation; rejection of criticism, contempt for it, and often persecution for criticism and others. It is proved that the most effective means political and legal mechanisms to overcome bureaucracy is debureaucratic that associated with of democratic transformation of public administration process, to decentralize of public life and, respectively, reducing the dominant role of bureaucratic apparatus.
